Is CBD illegal?

Many people are increasingly turning to CBD to help to alleviate conditions and improve wellbeing but is CBD illegal?  

CBD and products containing CBD are completely legal in the UK. They can be bought from retailers and used without a prescription as long as the CBD product meets the following conditions:-

  • It does not contain more than 0.2% THC.
  • It has been derived from an industrial hemp strain that is EU-approved
  • Is marketed in full compliance with existing regulations.

A key element of the legality of CBD products is that they must contain zero to very low low amounts of THC. This is the key differentiator between CBD which is legal, and cannabis which is illegal. THC is tetrahydrocannabinol, a psychoactive chemical found in cannabis plants, it’s the element that causes the ‘high’ traditionally associated with cannabis.

CBD that is legal in the UK and Europe is derived from hemp plants, which are a strain of cannabis plants that contain 0.3% or less THC. Because CBD products contain very little THC they will not make you ‘high’ even if you use a large dose.

According to EU law CBD is not a narcotic drug. The European Court of Justice stated CBD “does not appear to have any psychotropic effect or any harmful effect on human health.”

Is it legal to drive after using CBD?

Because CBD products contain very low amounts of THC and don’t get you high, it is safe and legal to drive after taking CBD products. You should also not test positive for cannabis on a workplace drug test because these test for THC. UK regulated CBD oil contains either very low amounts of THC or none at all.

How do I know the CBD I am buying is legal?

CBD has been classified under the UK’s Novel Foods Act (as of March 2021), this ensures the industry is regulated to protect end users.
